I know it hurts , but this was necessary to stop the misuse of H1B program.
The H1B was never meant to be used by Body shoppers.

You drafted this H1B law ?

    See how Numbers USA propaganda

They are saying these bills grant Amnesty.

    I pity them.

Please contact your U.S. Representative through the Capitol Switchboard (202-224-3121) and ask him/her to do everything possible to stop the passage of three bills in the House Judiciary Committee today: H.R. 5882, a bill that would add an additional 550,000 permanent green cards; H.R. 5924, which would add 20,000 additional foreign nurses per year for three years (plus their families); and H.R. 6020, which would grant amnesty to the illegal-alien spouses, children, brothers, sisters and parents of all 23 million U.S. military veterans

Aren't these pretty complex questions for them.

Why can't we ask a simple question like this?
    1. Given the green card woes lot of US eductated scientists and technical talent are leaving US for their home country. This is helping the home country and increasing outsourcing market. What are you going to do about it? Are you going to do any thing to keep them here?

Should I ask this question? Any inputs.

It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.

I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D

Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.

Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.

A career based on lies and deception is criminal in my humble opinion. There are people who actually came to US with valid experience and education, but still end up applying in EB-3 because the employer did not oblige. Sad for them, but it again boils down to the fact that if the job description qualified them for EB-2, then they got cheated. Otherwise, it is just.

I would like to clear the stand that I am a MS holder from an American university and I work as a Sr. Engineer in one of the top internet firms. I left an offer from that crappy operating system maker because that job did not require MS or even BS+5. It was BS+3. I chose a job where I get to apply in EB2.

People who crib about not getting a chance, even though their job description did not support it are wrong, IMO. NO ONE forced you in to that job. This is not slavery and US is not the only place where you can get a job.

Is this a legal option for a non profit? If so, I suggest we go for it!

Here is one scheme I have been thinking about:
    1. Every week members donate any amount they like over paypal
    2. At the end of the week one of them is selected and refunded 2 times his contribution amount
    3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.

consider the following players/amounts in a given week:
    user1: $20
    user2: $100
    user3: $10
    user4: $45
    user5: $25
    user6: $50
    user7: $25
    user8: $5
    user9: $10
    user10: $100
    Total: $390
    Divide by 10 users: $39
This week's selection process: Select the "average" donor.
Who donated an amount closest to the average? : user4 ($45)
    Therefore, refund user4 for $90

What IV received in the process: $390- $90 = $300

The other BIG question is: what incentive do people then have to sign up for monthly contributions, which is clearly the preferred way of contributing as it helps in planning and budgeting? The answer would probably be "bigger" prizes for those who sign up for monthly contributions!

Of course... if only people realize there can be no greater incentive than receiving your Green Card sooner/ being able to apply for AOS any time after LC/PERM stage is cleared.... we would not have to care about all these fancy ideas!

Too bad people can't see what is "2+2" until it is shown as 2*2*2 - 2^2!

If in 485 denial it is due to ability to pay and they state so in 485 denial and you were paid labor wage from priority date until you left and were eligible for ac21 then the denial would not have been in error and you would be fine.

I assume you meant to say "denial would have been in error".

@Snathan how did you know he didn't call me here , are you one of the consultants yourself who does this filthy work of cheating people.
I guess it was my employers discretion to make me sit home with him just not responding to my mails, i couldn't barge in to his office and say hey give me desk to work on? can i ?

Anyways looking at the LCA agreement i think you don't seem to know what you are talking about, I am here holding his company's name on my H1B form , His agreement on LCA and his employment letter, i dunno if there is any other way i could make inroads into barging into his office?

Now if he puts a security guard against me entering his office, shouldn't i report this to DOL too?

Mind your words you low life scum bag. You don’t know what you were doing and paid for H1B and landed here and informed your employer through email which states he did not invite you to the US though he applied for the H1B. By the way when did he informed about the project situation. go ahead and report DOL or even white house. I am sure you won’t get anything out of it as there are so many loop holes in your case. No one is going to pay you the green buck because you want it.

Getting emotional is not going to help you. Your case is not going to impact your employer until he is doing this as a pattern. The only other option is, if you can get another job apply for a transfer and the approval without I-94. Then you will have to go out of the country and come back.

Your first priority should be to get the job and fix your visa issues. Then find other employees working for this employer and if they are in similar situation like you. If so, you have a very strong case and complaint to DOL. May be you should use this as a leverage to get the pay stub and do transfer. Really speaking pay stub is not an issue as long as you are able to get a job.

You need to relax and think what do you want to do and whats your you want to put your life back on track or go after this guy. You can teach him a lesson but how it’s going to help improving your situation. Because of the current environment, no one needs to file any complaint and every application from any company is thoroughly scrutinized by the USCIS. Worst case he will shut the shop and open another one. All he needs is a $300 to register a company. USCIS is not going to deport him as he might be already on GC or USC. But there is every possibility for ICE to knock on your door. You are just shooting yourself in the foot. Good luck.

Aghast...... Can this happen? I think they have to return the application filing fees. Has any one else heard about this.
USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

For PMP I think, you need to take some courses, I had taken some courses at Berkeley Online on project management, these courses count towards PMP.
They also have in class courses, if you are interested.
Better to do something than nothing.

    Hope it helps,

    $$$$$$$$$$$$$$$GOOD EVENING GC$$$$$$$$$$$$$$$$

    Deadline = April 30th, 2011
Goal = 5000 votes on survey (see I-485 filing w/o current PD thread) and momentum to continue with this campaign. The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.
Actions - 1) Vote on survey.
    2)Email with PD, ph#,email & subject "I485 filing impacted,
3)Print/Circulate Fliers and spread FB, wiki link (see "support thread")

    Dear IV Members,

If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

For background click here -> Announcement about April 2011 Advocacy Days (
Contribute to Advocacy Event on the Capitol Hill ( (All one-time contributions will go towards organizing the Advocacy Days event)
