Just as an update for those anxious folks - I got my passport back with the stamp on Jan 3rd (Intv was on Dec 13th). Visa issue date was on Jan 2nd.
So plan for 'a month' atleast if you are visiting the Chennai consulate for H1b stamping.
Also make sure your photo is exact as per specs..Mine was taken in US (Costco) for the Green card process ..but the guy who is sorting all the papers in the consulate send me out to the VFS office to take another photo as he didnt like the way my photo was taken (although there was nothing obvious..no point in arguing to them)..I thought I was alone, but saw many folks outside ...I had to take this at the VFS office (close by..VFS shuttle is there outside the consulate) and return back to consulate..(will cause atleast 1.5 hours delay..I barely made it to my flight back home)..

One thing I did notice was the comment "it is soon becoming the voice of rich and/or EB2 Indians only -- all other categories will either have no direct advantage with the efforts put in by IV, or they will actually see some negative effect from its activities. But that will be the case with any organization that claims to stand for a particular class. In reality, every core group will stand up for it and only itself."

Jees, stop posting this over and over man.
Why not, we need all of you to be active state chapter members. If you are then this is not for you, but if you haven't already, then join and make a difference. We can have interesting discussions and there is absolutely no problem with it, but we also want members to further IV goals. As the model followed is an all volunteer model, all of us know, volunteering does not come as given for everyone. Some need to be inspired, so need to be pushed, if we did not have people who did this, IV would not be existent. Try to understand why people ask everyone to join state chapters. I will stop lecturing now, but yes, threads need to be hijacked to get the point across. Without grass roots organization we will not make any progress and will defeat the whole purpose of having an organization being build from the ground up.

While i am like everyone else in the fact that i want my GC i am not a selfish/greedy person (Like some of the members here on IV) who wants their GC at the expense of someone else
EB3 dates 2 years behind EB2 dates sounds resonable and if that ratio is kept then it will be beneficial to everyone. Not the way it is now.
What i want to see happen is that EB3 move to Aug 2004 dates while EB2 is at Aug 2006 keeping a 2 year difference between them, and maintaining the samne ratio moving forward

Whatever you do, don't flee the country. You might never be able to reenter again. And I don't know what kind of extradition treaty the US has with India so I don't know if fleeing will even help. I would say defend yourself and cross other bridges as they arrive.

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.
IV core will need lot of support to do accomplish this, hope at least some of the folks who got into IV because of the july fiasco contribute funds.

Looking at discussion going on here, its sure that IV have financial problems & only 5% (of total 8000 members) are contributing for the cause. Now, if we restrict IV website for "paid" visits, dont you think that IV membership is reduced by 95% to only 400 paying members?

11/16/2006: Update of Lame Duck Congress Agenda
# Report indicates that the House leaders more or lesss have determined that they will stay in session through the middle of December 2006 and hope to pass all the pending appropriation bills. Report also indicates that the appropriation bills have not moved an inch within this week because both the House and the Senate have been struggling to elect the new leaders in the both chambers. Accordingly, as we reported yesterday, we will not see any active and interesting legislative activities in the Hill until next week. It is thus obvious that the Congress may pass the Continuing Resolution at least until the middle of December 2006. If in the middle of December the Congress fails to pass all the spending bills and close the 109lth Congress after middle of December, it is likely that the Congress may pass another Continuing Resolution to fund the federal government through January 2007 and the remaining spending bills will have to be taken care of by the new 110th Congress in January 2007.
# Thus far, there is no indication of introducing Ominibus Spending bill. The report indicates that CIR may stay in limbo for the rest of the year owing to the complicated strategic interest involved in both parties as related to the 2008 national election and chances are that the discussion and debate on the CIR may not take place until the new majority party starts controlling the legislative agenda. However, we may have to wait and see whether any piecemeal legislative bills on H-1B and employment-based immigration may have any chance to make through the Lame Duck Congress as related to the spending bill legislation. Business community is actively working on this strategy and it may be the immigrants' interest not to be too vocal other than working very closely with their employers to push the Congress to help the business comnmunity. People should remember that when it comes to the legislation, the Congress may act on the constituents' voice, particularly powerful constituents' voice, but not necessarily on the immigrants' rights or privilege issues. Politics is politics and one cannot ignore the reality of the political process.

Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.
But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.
It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.
I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.
Is there anyone else in the same boat? How long does it take for MTR to get processed?

We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

For all of you who have got standard responses from USCIS, please do something about it. Call the local senator, file DHS-7001 with CIS Ombudsman, send a letter to USCIS secretary Napolatino, call TSC using POJ method, etc, etc.
If you are current, they need to look at your file. Case under review means nothing at all....my case was under review since July 20, 2009. Finally, i found out that my file was sitting in the storage and collecting dust.
As other previous posters have mentioned, you should try calling TSC/NSC on Thursday/Friday evening. I found out that the IOs were in a better mood, as compared to my calls on other days (specially in the morning/afternoon).
If you need details on the IO I talked to, I can provide it to you offline. I am still trying to reach that IO (need to say a big thank you) but have been unable to talk to him/her so far.

I have an approved EB2 labor cert thru PERM, and I belong to ROW. I am now preparing to file I-140 and I-485 concurrently.
I just saw my petitioner's(S-corporation) federal tax return. Gross revenue is $700,000; Net income is $20,000 which is only a quarter of my current wage. The offered wage per my labor cert is $80,000.
Do I have a big chance of denial in the I-140 stage due to employer's inability to pay? Please advise.

CIR will be as controversial as ever. SKIL, if any is our best bet.
CIR seems to be a perpetual wait. Both parties will not close it.
They need big issues to bicker and promise the electorate
for the next election.
IRAQ and CIR will be those big tickets they will use as levers.
Sorry to sound negative, but it is just the way I see it.SKIL is our only option, IF AT ALL. CIR is just an illusion and who knows if our provisions will be in CIR even if it becomes a reality ??!!!

Friends, I already have expressed the views regarding Recapturing/ temporarily increasing Employment Based Visa Numbers for Greencard, on change.gov website . I have been getting E-mails from Transition Team. I have pasted this recent E-mail which is about Meeting with Transition Team. I think, IV Core Team members or/and people living around Chicago area should arrange meeting with Transition Team, and express and suggest our ideas regarding Recapture/Temporary Increase EB greencard Numbers to clear the backlog.

In addition to presenting ideas as individuals at www.change.gov, the American people deserve a "seat at the table" as we receive input from organizations and make decisions. In the interest of protecting the personal privacy of individuals, this policy does not apply to personnel matters and hiring recommendations.
Scope:
The following information will be posted on our website:
1. Documents: All policy documents1 and written policy recommendations from official meetings2 with outside organizations.
2. Meetings: The date and organizations represented at official meetings in the Transition headquarters or agency offices, with any documents presented as noted above.
This scope is a floor, not a ceiling, and all staff are strongly encouraged to include additional materials. Such materials could include documents (recommendations, press releases, etc.) presented in smaller meetings or materials or made public by the outside organization without a connection to an official meeting.

Process:
Prior to an official meeting with an outside organization or organizations, Obama-Biden Transition Project staff members will inform attendees that any documents provided will be posted on our "Seat at the Table" website found at www.change.gov. Suggested language for email invitations is: "By presenting or submitting any document at a meeting with the Obama-Biden Transition Project, you agree to allow the document to be made public and posted on www.change.gov." At the completion of each meeting or upon receipt of such documents, Transition staff will provide the documents to [REDACTED] with the date of the meeting, a list of the organizations in attendance, and the topic of the meeting.
Notes:
1) This policy does not apply to non-public or classified information acquired from the Agency Review Process and internal memorandum.
2) An "official meeting" is defined as a meeting with outside organizations or representatives of those organizations to which three or more outside participants attend.

Was your previous approval based on an extension ? [Pending LC/Approved I-140 etc] ?
Yes. It was pending LC and they approved my I-140 last week. The status update happened immediately after my I-140 approval.Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ? Yes. It was LC that was pending with my previous employer. Were you paid the prevailing wages mentioned in the LCA of previous H1B ?
Yes. I was getting paid little more.
Can this be supported by the W2 of last financial year [Not the paycheck].
Yes.
Did you have I-94 attached in the previously approved H1B ?
Yes.
