Bashing the system and correcting the imbalances are correct. But some people in this forum are targetting individual persons(some times Senators) and doing personal attacks some times bad words also(I can see atleast 100 postings like that). No one realise the fact that same right we were not able to get in our own country. Can anyone talk to MLA or MP in India by phone when they want if any issue?. So we need to appreciate that we got extra freedom than our own country. If we want to correct problems in the system we have to fight with patient with point in mind that we are aliens compared to those who came here 20 years or 100 years before us.
Everyone on this forum or at least most of us on the forum know what are the downsides in indian system. Every one can write thousands of pages . I agree with you that India has problems and I am the first one to agree.
The momemt one starts comparing both countries , It is a race to bottom. Hope you understand.
At least personally I have so much respect for the system. Dont think that who questions an unfair system is less appreciative of USA.

I am taxed every month for social security though I am not eligible for any of those benifits as of yet. I always thought if that is the price I have to pay to make America my home I thought I would do that happily.
I still have beleif in the system and hopefully something better comes out .

it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

In my view H1B problem is directly related to Retrogression problem. Lets step backwards and analyze this.
Why so many GC were applied at the first place that caused retrogression. Because a large number of people came on H1B to US. All these people who came to US on H1b did not actually had any extraordinary skills. These people somehow got in touch with these Desi Consulting companies and came here without any skill and without any projects. These desi consulting companies applied there GC irrespective of the fact that these guys have a job or not. Some of the people I know have sat on bench for years, living with their relatives, unable to get any job. But they had their labour filed. These knid of people would not have made to US, if these fadudent companies were not there.
Also big companies, have a policy not to apply GC before one year of service. The point was that these companys will file GC only if they feel that the employee adds value to the company. But with these desi companys people have filed GC even before joining the companys.
In essence if the GC process was working without these Desi companies, I can bet that the number of GC applied would have been much lower than what have we currently have.
Substituted labor has further added to this problem.

I am married to a US citizen and I got my I-485 interview on 1/4/08 and IO said we have no problem about the interview. He said if I had my NC cleared I would get the GC in 2 weeks.
I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)
I have a few questions;
1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?
2- Most of the cases here seem to be about EB GC. Is there anyone who has the same problems with me? Is the procedure different for GC through marriage?

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.
IV core will need lot of support to do accomplish this, hope at least some of the folks who got into IV because of the july fiasco contribute funds.

For all of you who have got standard responses from USCIS, please do something about it. Call the local senator, file DHS-7001 with CIS Ombudsman, send a letter to USCIS secretary Napolatino, call TSC using POJ method, etc, etc.
If you are current, they need to look at your file. Case under review means nothing at all....my case was under review since July 20, 2009. Finally, i found out that my file was sitting in the storage and collecting dust.
As other previous posters have mentioned, you should try calling TSC/NSC on Thursday/Friday evening. I found out that the IOs were in a better mood, as compared to my calls on other days (specially in the morning/afternoon).
If you need details on the IO I talked to, I can provide it to you offline. I am still trying to reach that IO (need to say a big thank you) but have been unable to talk to him/her so far.

Point 1: We need to target news media here in the US primarily, not abroad. All good publicity is welcome, though. Please see a new thread started today by one of the moderators called "Ideas to increase Publicity of IV." There are key action items outlined there that every member can help out with.
Point 2: What will be shared (and with whom) will be decided soon by the core group. We used to send out regular updates, but that has suffered lately because we are all volunteers and some volunteers who were in charge of it are tied down with other things at work and home.
Point 3: We are already talking to people in academia and the academies.
Point 4: No member is "discounted." All are welcome, but we really need non-paying members to start chipping in money. What people decide to contribute is their business, and entirely theirs. Whether it is $20 or $50 or $100 or $500...that is entirely the call of the individual. This activity is not cheap, rather it requires a steady cash flow. We are obligated under the laws to hire a CPA and everything will be handled and accounted for.

While word-of-mouth is effective we can augment this to get attention using other means:
1. We can persuade news portals to advertise for our cause in a corner that might help us to get more people. Most Indians I know read Indian news everyday. If we can convince e.g., eenadu.net a telugu newspaper, to run ads we can get attention of lot people.
2. Please start selling the current acheivements that are not confidential. Like you might have been successful in persuading a high profile senator about this problem. Put his quotes on our site and also possible grab attention from bloggers.
3. If we can also tap academia who support skilled immigration that would help us. Let us put there studies in our reference section (I am assuming we didn't do this yet). This
makes senator to reference our site and make their lives easy.
4. Please do not discount freewill members who do not have a GC problem but savor
helping others with immigration problem. It could be Americans or Immigrants we'll get them all in.
I think these actions will help us grow our strength. I know it is easy said than done. I will send a mail to rediff and eenadu to put our banner on their frontpage. If anyone has contacts working for these website. That will make it whole lot easier.

There are literally hundreds of thousands of people from India and China ready to take your or my place if we go back. This is even if you tell them they will be stuck with the same employer and job profile for years, and no hope of a GC for the next 7 years. The lure of the US is still big. Reverse-brain-drain threat is unlikely to work...

I don`t think, that beside a miracle, the CIR will pass before the end of the year.
I am little bit more positive about the future, why:
- Immigration is the only point where you can find an agreement btwn Bush and the Dems, so to honor this new clime about bipartisan, immigration will be the only point to do it.
-There was an article in the Business week where they are already discussing about the sign ceremony
-Latino voters: not so important NOW, but they growing and 70% voted Blue.
- Watch out the senator of California, Fiengsten, she will fight any skill bill.
- Be positive, Hastert and Sensebrener has gone, they were the worse!

So, in that aspect, Comprehensive/Fixed appears to NOT matter at all. These are just pricey nouns. I can't believe that K.V.Rao's insurance lying publicly that it's a not-for-profit. These ridiculous kinds, stoop to such a level of cheating people with a Indian name on it.
I'm still open for any recommendations here. I appreciate all your comments & suggestions so far.

you have a PD only if you are in a pool that has a restriction on the number of GCs that can be issued in one year. if you are exempt, basically you don't have a PD. That is, it is always current. You do wait for them to finish processing your I-485 for which there will always be a processing date, which may or may not be current for you.
Also, please don't give any such ideas to USCIS; they may like this particular idea :D

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!
RECAPTURE OF IMMIGRANT VISAS LOST TO BUREAUCRATIC DELAY.
(a) Worldwide Level of Employment-Based Immigrants- Subsection (d) of section 201 of the Immigration and Nationality Act (8 U.S.C. 1151) is amended to read as follows:
�(d) Worldwide Level of Employment-Based Immigrants-
�(1) IN GENERAL- The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of--
�(A) 140,000; plus
�(B) the number computed under paragraph (2); plus
�(C) the number computed under paragraph (3).
�(2) UNUSED VISA NUMBERS FROM PREVIOUS FISCAL YEAR- The number computed under this paragraph for a fiscal year is the difference, if any, between--
�(A) the worldwide level of employment-based immigrant visas established for the previous fiscal year; and
�(B) the number of visas actually issued under section 203(b), subject to this subsection, during the previous fiscal year.
�(3) UNUSED VISA NUMBERS FROM FISCAL YEARS 1992 THROUGH 2007- The number computed under this paragraph is the difference, if any, between--
�(A) the difference, if any, between--
�(i) the sum of the worldwide levels of employment-based immigrant visas established for each of fiscal years 1992 through 2007; and
�(ii) the number of visas actually issued under section 203(b), subject to this subsection, during such fiscal years; and
�(B) the number of unused visas from fiscal years 1992 through 2007 that were issued after fiscal year 2007 under section 203(b), subject to this subsection.�.
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!

I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.
What happened to the IV's talk with USCICS on spillover policies? Does anybody know?
my thoughts exactly - they are just relaxing till summer season !! and maybe they will make the dates current in last quarter too - this means more mess but more $$$$ for them.
time to make plan B = plan A. and plan C = plan B.
my plan C -- make more money, save more and buy less with eventual return to home country if needed !!
