In the midst of all the hype and bickering about ILLEGAL immigration, there is a group of people, often forgotten and ignored, who are caught up in a bureaucratic mess and yet are patiently waiting on the path to LEGAL immigration. This is a group of high skilled workers, most of whom have advanced degrees in medicine, engineering and science from Universities in the US. These people have obeyed all laws, worked hard, paid taxes and waited their turn, many for a decade, because of a system that is hopelessly broken and inefficient. I am one of these people and I have been in the US legally for 10 years and still years away from getting a green card. As the President of the United States how do you intend to address the problems faced by future Americans already living and working LEGALLY in the United States? How many core IV members have already received their GCs besides Aman, just curious?
Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.
It would be nice if someone in the core team updated the rest of us, who cannot join the state chapters due to personal reasons on the website.
AFAIK, logiclife and pappu are just temporarily off IV due to some other priorities and will get back on board with a big bang soon. How do I know? I spoke to pappu recently.

I would rather loose $305 than keep waiting for some miracle. Thanks for your help. I should be able to find the procedure to file 7001 and the Napolitano address in this thread, correct?

I hear people say that there is reverse brain drain. But this is not completely true. I cannot quantify in numbers but there are certainly few people, I know of, who have migrated to countries like Canada and Australia.
I will not call it as reverse brain drain but diversion of brain drain to other pastures that may be worthy from individuals standpoint.
Reasons could be endless, to name a few - stagnancy in career growth, frustration for wait for GC, inability to invest further in housing for job insecurity, longer time for family union (ageing parents), save kids from western culture, etc.. etc.
I have heard one of the above reasons, while there could be more, from people who want to vent out their frustations. But rest assured very few choose to put it to action at the end of the day.
My two cents - don't bash others. I believe that all of us go through this turmoil at some point or the other.
Let's stay focussed on what you want. Most of us, if not all, are here for better life, career growth, money ;), etc and if other countries offer better prospects and meet majority of ones expectations, most likely, we will consider the options. I think, to a certain extent, we are patriotic to our ownself or if may call - opportunist.
Given a scenario. EU Blue card gives better option (though not sure if it will :p) flow to newer pastures is inevitable and unstoppable. This may not appeal to 100% of the readers but it's one of the faces of dice.

I initiated the transfer on 19th and they delivered it today i.e 3 working days after (which is two days less than there norms). Also the rate is 43.35 today as per the calculator and they show a rate of 43.01 for my transfer. ICICI is a known thief. That is how the company is made. Its like "there is a CRIme after every successful company".

Guys, guess what I am holding in my hand? Yes, that bit of plastic, object of our fantasies �.and nightmares. After filing Writ of Mandamus on November 1st, things went amazingly quickly and smoothly: on December 1st, the US attorney gave confirmation that the case has been approved and I received the card in the mail on 12/07.
What did I feel then? Really indescribable�Happy? It goes way beyond that.
I feel more relieved than anything else, like if I had a ton of lead off my shoulders�
May my story inspire, give hope and faith to all of you guys who are so depressed at the moment because of what happened, or did not happen should I say, in that shameful Congress.
As you will see, I had my head in a brick wall more than once. More than once, I was devastated and, still, I never gave up and made it through.
So, please, enjoy the holidays: as long as there is life, there is hope.
I know something about it:
Come here in 1993 as a student on F1 visa. Graduate and got Work Permit (OPT).
Find dream job in dream company. Hired directly by CEO himself.
Company loves me and applies right away for H1 and then Labor Cert.
Life is beautiful. The start of the American Dream. Not for long.
Attorney has been working for company for years. Always successfully.
Picks me for his first failure: screws up completely.
H1 denied. Labor Cert denied. Company gets mad: attorney is fired.
OPT runs out: company still loves me but�I am now out of status and�fired too.
Welcome to America. Life has turned dark. The start of my American Nightmare.
I am disgusted. Decide to go back to my home country (France).
I miss California. Find new company that loves me: apply for H1 again (this time, I am paying all fees, out of my meager savings).
H1 is approved, got stamp at embassy in Paris. I am back. Life is beautiful again.
Not for long. Exactly 2 hours (no kidding).
Find out that company is a sweat-shop and boss is a crook.
Pays me half (yes, half) what he was supposed to.
Go to INS to complain: �If you are not happy, go back to your home country�.
I swear that it is exactly what I am told.
Consult attorneys for a possible lawsuit: � Alas, your situation happens more often than you can imagine. Many unscrupulous employers use and abuse of would-be immigrants like you. Don�t waste your time and money in a lawsuit, just find yourself a new job�and be more careful this time�.
I am broke. Can�t even go back �home� and anyway I don�t want to.
Not with just my tail between my legs for the second time.
Home is here. I want my American Dream and I will get it, no matter what.
Decide to swallow my pride and endure the humiliation until I can find new employer willing to sponsor new H1 and pay all fees. I just can�t afford anything as I am hardly surviving.
Employer wants to fire me: �you are always complaining about the money�.
I have to threaten him (yes I did) to report his company to Dept. of Labor (most his employees are illegals and as abused as I am, not getting paid for overtime and so on�).
Imagine in what kind of atmosphere I am working�but I need this job to remain legal until I can find something else.
For sure, I will be out of there within a couple months at the most.
Don�t know yet that this nightmare will last�2 years. Still can�t believe it.
Had I known, I would have fled the first day, no matter what.
In my specialty, jobs are not easy to find.
Not to mention that this time, I have to be very �choosy��
Companies that I approach:
a) don�t want to hear about immigration or
b) don�t want to pay attorney fees or

Get EAD. FP in September 2004.
Things change: company is now going down. Boss still loves me but�lays me off.

Attorney says: �Don�t worry (!!!) Employer loves you. Won�t revoke I-140. GC is for future job. Find new H1 job to maintain status and see what happens�.
This time, I am lucky (!) and find right away new H1 job. Company is OK, job is OK.
Later, previous company nicely recovers: got rehired!
Only thing: I will have to pay all fees from now on. Don�t care. Back on the right track.
Do Medical in April 2005.
I-140 approved in May 2005�but visas are now �Unavailable�. Nothing to worry about.
October is around the corner and new numbers will be available, right?
Just a few more months and I will have my GC. Wrong.
October bulletin comes out. EB3 World is back to March 2001 (PD is 01/2002).
I swear that I almost s..t in my pants. When is too much�just too much?
How much more frustration and anguish can I endure? More, much more.
By rage and stress, I pack up an extra 20 lbs in just a few months.
Most people lose weight when they are under extreme stress and/or depression, I do the opposite. I am now 40 lbs overweight.

12/05: receive Approval Notice in the mail and my attorney indicates that she will then dismiss the Mandamus complaint.
12/07: receive the Magic Card in the mail (regular mail, even not certified, unbelievable�).

I'm getting married in August and my wife will be here in Sep/Oct. My PD is pretty recent - May 2007 EB2 (India). I'm planning to file my 140/485 (concurrent) and maintain my H1B for now and also bring my wife on H4. As long as she wants to be on H4, I'll maintain my H1 and once my PD comes CURRENT again, I'll file her 485.
Now, I've heard that my 485 won't be approved before my date is CURRENT again. Once the bulletin releases and if my date is CURRENT, I'll send my wife's papers to USCIS immediately. But it seems like I can get FP notice even before my dates become CURRENT. That case, my FP and other stuff might finish early and my wife's late. Does this affect her case in anyway as there is every chance that my 485 gets approved early and hers late. Will she be "out of status" because of her 485 pending and mine approved.
What do you suggest ??

Guys, on a side note, please be aware that while you are residing/employed in the US and you pay and file tax returns for your employment in the US, per US laws/regs you have to pay taxes on your "worldwide income". Now there is a dollor for rupee tax credit, but assets taxed in the two countries differ and their rates differ too. So if you buy property in the India while in the US you may need to declare it or any rental income you may receive from it on your US Tax Returns while you continue to reside/work in the US.
It is pretty complicated and you will need the services of an International Tax Accountant.

Is this a legal option for a non profit? If so, I suggest we go for it!
Here is one scheme I have been thinking about:
1. Every week members donate any amount they like over paypal
2. At the end of the week one of them is selected and refunded 2 times his contribution amount
3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.
e.g.
consider the following players/amounts in a given week:
user1: $20
user2: $100
user3: $10
user4: $45
user5: $25
user6: $50
user7: $25
user8: $5
user9: $10
user10: $100
________
Total: $390
Divide by 10 users: $39
This week's selection process: Select the "average" donor.
Who donated an amount closest to the average? : user4 ($45)
Therefore, refund user4 for $90
What IV received in the process: $390- $90 = $300
The other BIG question is: what incentive do people then have to sign up for monthly contributions, which is clearly the preferred way of contributing as it helps in planning and budgeting? The answer would probably be "bigger" prizes for those who sign up for monthly contributions!
Of course... if only people realize there can be no greater incentive than receiving your Green Card sooner/ being able to apply for AOS any time after LC/PERM stage is cleared.... we would not have to care about all these fancy ideas!
Too bad people can't see what is "2+2" until it is shown as 2*2*2 - 2^2!

There is diversity visa for that.
The intent of US immigration (employment or otherwise) is to import diverse population such that it benefits US in various different ways (socially, culturally, economically). Employment category comes under the larger umbrella of such goals.
Put yourself in ROWs shoes and if you claim that you still believe in abolishing the quota, then I will agree you are a great person. I am not, because if I put myself in their shoes, there is no way I will support this action.

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.
I went to Infopass today, unfortunately service rep on counter was totally uncooperative. She did not tell anything other than my background check is still pending. It has been pending for more than six months now. I understand that my PD is not current as of yet but, based on recent movement, I hope to have my date current in next couple of months. But, it may not help me much if BC is still pending..
Any suggestions from IV.. What can I do about it? I planning to get in touch with my attorney but, I don't think they can be of much help..
