One of the IV members has requested me to post this info.
He contacted his senator to get the total number of pending EB apps for India.
Please see the response from the senator in the following link. It has pending applications by category.
http://sites.google.com/site/gc28262/Home/Eb-IndiaPendingApps.pdf.pdf?attredirects=0
Thank you for great effort. I hope you are not pulling a prank.
Who is the IV member that has asked you to post this info?

hi,
Will it be ok to take zerox copy of Green card both Front and Back of the card. I am not sure whether I can take copy of back side of the Greencard...
Can somebody post their experience.
Thanks
You want to know the "experiences" of people on how to take a photocopy ? I believe you got your GC in EB-2 category, so you should be skilled enough to know this.

Niether many has tried this option (entering on AP and filing H1B transfer to different employer other than GC sponsers) nor USCIS has strong history of approving/dealing with these type of cases. After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. However, there is no specific memo to address this situation (Transfer). It is all depends on the individual adjucidator's logic. If they see your latest I-94 with parolee stamp, then they may deny (or issue a RFE )the H1B transfer, by the applying the the logic of one must be in the smae status to seek extension. If the deny/issue RFE, you can not counter act as there is no secific memo or policy by USCIS in this case.
Ramba:
if the transfer/extension of H1B gets rejected after travelled on AP, is it possible to move on EAD and continue working legally? I am talking worst case scenario here.
Although my lawyer confirmed that one can still have a valid H1B status after travelling using AP. My co-worder is still in doubt. Our corporate attorney seems to be clueless for this tricky situation.

There are others who advised you about what to do so I am not adding to it. If you want to prevent this happening to others you can expose the company here and in other forums...
the worst idea ever.
first - probability that potential employee of that employer will read it is zero.
second - employer continues to act same way to other people.
third - employer can actually sue him for doing so.

In my opinion USCIS will not give inaccurate information, in writing, to a Senator. The letter clearly mentions 'Application Pending for India'...
USCIS might not have intentionally given any incorrect information. Perhaps to them what they sent means "EB applications pending for India". Key part is "for India", which quite likely does not mean chargeable to India.
I doubt if they can easily track out applications chargeable to India that easily (even if $5K is sent to them). Whatever is entered in the system when USCIS receives paper applications (e.g. name, address, date received, category, date I-140 approved, etc.) can only be used as a criteria for queries. Birth country perhaps is only on paper application, and is verified for approrpriate chargeability at adjudication time. Systems are not designed for handling cases where country of chargeability is, as is the case for us, the final stopper.

Where is your case? I am sorry if you have already mentioned it before. If its TSC, please send me a message and I will give you the name of the officer. Please try to call around 4 PM tomrrow.
For all those who have sent me pvt. messages, I will mail you a copy of the letter I sent out to Secretary Napolatino and first lady in the evening today.
wow!!!..just amazing. But irony is that while your case was pending, nobody informed you that why case was sitting on the shelf.
Never mind- sometimes, no activity is actually good. I am seeing repeated LUD's on my approved 140 and now wondering what is going on.

gimmi green,
I am wondering how did you do that? I am in same situation but I always thought that you have to stay with the company who has filed your 140./ I have 140 approved and wasting my time with the company every day but at the same time started real estate business with my partner part time. I am wondering if there is any way to keep your green card going and at the same time work for your comoany. I really appricate your insight.
Thank you.
gimmi green - Don't you see green around you. Let me tell you how to get green
1) Use your credit history to purchase additional home in Florida. House purchase in 150000 will be 250000 in year. The market was like that a year back. It takes 8 months to get a house. There is a big line.
2) Open your own e-business. File E visa. 1/4 million should be easy money if you have stayed here for 10 years.
3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.
4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.
5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.
Am I doing it? Yes.. Did I make money? Yes.
Ensoy.

If possible taken an infopass appt. They might be able to tell you the correct status of your appln.
BTW: Does any one know how long does it take for a decision to be made on an application once it has been pre-adjudicated and assiged to an IO?
9/11 - assigned to IO

Hope this helps!

Some of the reasons I can think of
Employers will be right in the eyes of the law since there will be an agreement signed by both parties, the law does not care if the agreement was signed under duress, under mild threat or when the employee was ignorant.
Employer is legally bound to pay only what is in the LCA, that amount will be way less than what you get by pay rise, percentage or whatever. So when the employee leaves the employer could keep majority of the share and give only what is mentioned in LCA.
Good employers treat both their current employees as well as old employees equally and that is how they grow, but bad employers dont. They do not want the employee to leave when they do not have a GC yet, so they will try all the tricks in the book (perfectly legal but highly unethical and totally unprofessional) to keep him saying that if an RFE shows up, they might not be able to respond in time if they are not with them.
They do not find projects, but since the employee is on their payroll, he will find a job himself to remain in status. Here too the employer has not broken any law.
In all of the above instances do you have a case to sue the employer?. No, even if you do have a case do you sue them?. No, cause you need them and then history repeats.

We are really now in a global credit/liquidity crisis. Please see the link below to see the cash crunch the major real estate players like DLF are in. This article is from July so you can imagine what September would have been like for them. Prices have already come down in major centres. Currently there is a game of chicken being played between builders and end use buyers. Every indication is that very soon builders will have to cut their losses and sell their flats at deep discounted prices.

If you have secure permanent job with a solid Company,it is better to buy a home. I have a well secured job and I bought the house back in 2002. Home prices were less in 2002 compare to 2006.
But, if you are a consultant or working for a small company ,it may be better to wait till you get GC. But remember one thing, even if you get GC or Citizenship,if you loose your job and have a big mortgage to pay off,you will be in big trouble to make the monthly payment. This is true for even US Citizens !
But, if you are optimistic and ready to take some risk, you may be making some Good amount of profit in the future ! I was very optimistic and took some risk in 2002 and now I am in a Safer Side ! Think about it
Buying a house is a risky proposition on H1 specially considering the fact that if one is laid-off and needs to relocate within a short-time then one may end up loosing money. Besides getting into the hasseles of home maintainence is trouble-some and expensive and probably not worth the time and effort if one is uncertain about their future in this country.
Having said that if an individual is good at taking calculated risks and has a secure job then rewards are truly exceptional. I would rather wait atleast till the time of filling I-485 before making any long-term investments in this country. I know lot of my friends are probably going to do the same.
Good luck.

I watched the whole debate, unfortunately ( as expected) they never touched on the question we voted on or the other most popular question about Katrina. There were other popular question too like NASA related stuff which never made it.
Anyways we all did a good job within a short time to bring our question to #2 in the most popular list.
We will try this in the future debates too.
Once again thanks to everyone who did there part in this.

Everybody please go the URL http://dyn.politico.com/debate/democrats/VoteForQuestion.cfm
and vote for question number 20 .The question number is changing please look for the text below and the title "Immigration" before you vote
The question is
---------------------------------
This question is NOT about Illegal immigration but Legal Immigration issues at the govt. level... What do you think of and plan to do about the broken naturalization process that is currently hurting nearly half million highly-skilled and taxpaying legal immigrants already working productively in the United States who find themselves trapped in a system that is taking years longer than intended. The greatest impact of the broken green card process is borne by the legal immigrants and their families. Some of the major grievances faced by the legal immigrants are that they are forced to be stuck with the same employer for years; their spouses not allowed to work, they have a very limited travel freedom and so on. With the current backlog in the system a highly skilled high-tech engineer could take up to 7-10 years to get a green card. Isn't that an unfair deal for a person who works so hard to fulfill his American dream? Again: This question is NOT about Illegal immigration but Legal Immigration issues at the govt. level...
--------------------------------------------------------
ALSO VOTE FOR THE SECOND QUESTION (also an immigration question text follows)
-------------------------------------------
Illegal immigration has been a topic of heated debate and has received much needed attention during this election. In the midst of all the hype and bickering about ILLEGAL immigration, there is a group of people, often forgotten and ignored, who are caught up in a bureaucratic mess and yet are patiently waiting on the path to LEGAL immigration. This is a group of high skilled workers, most of whom have advanced degrees in medicine, engineering and science from Universities in the US. These people have obeyed all laws, worked hard, paid taxes and waited their turn, many for a decade, because of a system that is hopelessly broken and inefficient. I am one of these people and I have been in the US legally for 10 years and still years away from getting a green card. As the President of the United States how do you intend to address the problems faced by future Americans already living and working LEGALLY in the United States? Please note, this question is NOT about ILLEGAL immigration but about LEGAL immigration.
---------------------------------------------------
Let us try to get as many votes as possible from all the 25000 members . This is a good chance for all of us to get this issue out to the public. Please tell your friends and family who are not members on immigration voice, ask them to vote. This vote mayn't get us anything except a lame answer but atleast it will get us a big audience to hear our problem and also help us to differentiate ourselves from illegal immigration issues. FOLKS DO YOUR BEST THIS DOES NOT COST MONEY. THE POLL MAY CLOSE BY TOMORROW MORNING.
