Can we have some kind of time line that IV core/lobbying firm has knowledge of about S .9 and what might or will happen in March, just in another 15 days.
If I call the IV number, can we get the future time line.
My GUESS is that, it would take same time (if not more) for S9 as it would take for the IRAQ issue in Senate and House.
I think if it wasn�t for the IRAQ fiasco we would have had our issues resolved a year back.
And the start of S9 won�t happen till IRAQ issue is resolved/voted/rejected in senate or house.
I think the biggest hurdle for S9 would be the request by Democrats to DUBYA to provide certain number of votes from Republicans. This is exactly what is wrong !!! Why the hell do we feel that it is unjustified?? Not only for EB3 or EB2 or anyone for that matter ?? Congress has the authority to pass laws, even something as insane as "no EB immigration for the next 20 years" or something like that. IMMIGRATION is a priviledge, NOT a birthright. India has its laws too, my son who was born here has to report every 6 months like a criminal even though he has a valid visa in India?? Is that unjustified? NO, it is the law in INdia. Students at national universities in India from foreign countries pay in excess of 100 times what an indian student pays, is that justified ? NO, it is the discretion of the UGC.

The US is not perfect but it has pretty generous laws and the USCIS is not perfect but it is trying. The question is none of the Admin fixes in last one year has helped EB3-I. In fact, it made our situation even worse.
it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.
The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?

This might sound weired..but I think we can get some support from Housing Market !
Facts:

The housing market is slowing down significantly and there are millions of unsold homes out there.
More than 1/2 million people are stuck in the green card process. I am sure
most are waiting for green card before they buy their house and make longtime commitment.
I think we are a "Frozen" pool of customers for the Housing Market.
500000 H1B X 300000 (average house price) = 150 billion dollar market is just
inaccessible just because of retrogression.
I think we should convince them to help us FINANCIALY

Absolutely not. AC21 only removs the per-country limit in any calendar quarter in which overall applicant demand is less than the total of available numbers. In the present calendar year, the overall demand is defenitely more than the total of available number and AC21 priviledges would not apply.
DOS would clearly violate the 7 percent limit if excess EB2 ROW numbers flow to EB2 china/india. Don't want to get into an argument here, so I will leave it at this. Each person is entitled to his/her interpretation just as DOS has its own. Peace.

You have summed it up correctly. Comprehensive insurance from a reputed US company/broker like AIG (not TATA-AIG) is the way to go. I had the same for my parents. Luckily, there was no need for us to use it but I know friends who have used it and were not left in soup (it worked as well as it was supposed to work).
Recently, one of my friend's dad came to Texas and got sick and the bill came to $60K. Unfortunatley, he did not buy travelers insurance and is fighting an uphill battle with the hospital.
My parents are coming next month, so I did a detailed research on all the insurance firms, both in India and in USA and I found that most of the ICICI or Tata-AIG plans have limited coverage, which limits the number of days in an ICU or visits by doctors etc.. Even if the plan has a $100K max, the plan may only cover upto $1000 per day for 30 days or so and then there is limitation for ICU and other surgeries. However, if you take a comprehensive coverage, then whatever the expenses, or wherever the charges are incurred, it does not matter. The total amount upto $100K will be covered and it does not limit ICU charges or room charges or doctor visits etc.
The only reason we need an insurance for parents is to cover emergencies, rather than regular doctor visits. Generally, any emergency run 60-70K, so I would recommend a minimum of $100K and do a comprehensive coverage. I have worked with IMG or check this guy at http://www.visitorshealthinsurance.com/
I even called IMG to ensure that this guy is an authorized re-seller/broker for the insurance.
Additionally, I did not find any insurance that covers pre-existing conditions. So just pray that they are healthy during their stay in US.

The amount mentioned in the lawsuit ($3.25 M) is totally irrelevant- what they would eventually get (if any), will be far far away from this figure.
Assuming that there are no criminal charges, and this is a civil tort case, there will be no impact on your immigration proceedings at all.
Make sure you take all the paperwork very seriously and do not ignore any letter/notice/deadlines. Don't even think of running away- its not worth losing your career you have worked so hard for. Unless yours is an extremely unusual case, all that you stand to lose is several nights of sleep and thats all.

I am already in touch with my insurance claim representative. He told that the insurance's attorney will be responding to the suit and requested me the send the papers asap (which I am going to do today). and they will take care of attorney's expenses.
One more thing that he clearly told is, that they can pay up to $50K and beyond that I have to take care.
-- I don't have any assets here(like shares, house etc)
-- Though I have a house in my country(not sure that would be counted as asset here in this case)
-- Even my bank balance is minimal
I already went thru lots of pain since the accident, and when I thought its all over, it is coming back..Hope I will be able to pass this test, as it is not as complicated as long waiting of GC :)

After you have worked with us for about 6 or 7 months we will file your green card and you will have your green card within 3 - 4 years. I agree with your point. So, wait for some more time. Right now most important thing is to hold your money tight. When you have a job market highly volatile, most important thing is to have money in hand for bad time (I pray to GOD that no one get to see this time).

Abhijit, you are correct about the quotation marks. Unfortunately I had to create a new petition since I couldn't modify the old one as it was already signed. I guess I messed up and overstated certain things in the old petition.
